Bankruptcy courts are federal — you file in the district where you have lived or operated a business for the greater part of the last 180 days.

Filing Day Guide

What Happens On Filing Day?

A step-by-step look at what to expect when you walk into the courthouse.

1

Prepare Your Filing Packet

Your complete set of bankruptcy forms, schedules, and supporting documents. The court requires specific forms depending on your chapter. JustiPal™ helps you organize these documents before you file.

2

Arrive at the Courthouse

Bring all forms, documents, and your government-issued photo ID. Some courts accept filings by mail or drop box — check your local court's procedures.

3

Pay the Filing Fee

The current filing fee for Chapter 7 is $338. Courts accept cash, money order, or cashier's check. Personal checks are generally not accepted.

4

Fee Waiver

If your income is below 150% of the federal poverty line, you may qualify for a fee waiver (Form B 3B). You can request this at the time of filing.

5

Installment Payments

If you cannot pay the full fee at once, you may request to pay in up to 4 installments (Form B 3A). Your case will be dismissed if installments are not paid on time.

6

Receive Case Number & Notice

After filing, you receive a case number immediately. The automatic stay goes into effect — stopping most creditor collection actions. You will receive a notice by mail within a few days.

7

341 Meeting Scheduled

The court will schedule your 341 Meeting of Creditors approximately 21–40 days after filing. You must appear in person or by phone.

Court procedures vary by district. Always verify specific requirements with your local bankruptcy court before filing day.
