What Is the 341 Meeting?
The 341 meeting is required by federal law under Section 341 of the U.S. Bankruptcy Code. It typically occurs approximately 30 days after you file your petition and is held at a federal building — not a courtroom. The meeting is overseen by the bankruptcy trustee assigned to your case, not a judge. Creditors have the right to attend and ask questions, but in consumer Chapter 7 cases they almost never do. The trustee's purpose is straightforward: verify your identity and confirm the accuracy of the information in your petition.
What to Bring
Arriving organized with the right documents ensures the meeting proceeds without delay. Here is your complete checklist:
- ✓Government-issued photo ID (driver's license, passport, or state ID)
- ✓Social Security card or official SSA document showing your full SSN
- ✓A copy of your complete filed bankruptcy petition
- ✓Bank statements (last 2–3 months)
- ✓Recent pay stubs or proof of income
- ✓Tax returns from the past 1–2 years
- ✓Any real estate documents if you own property
- ✓Any vehicle titles if you own vehicles
What the Trustee Will Ask
These are the standard questions asked at nearly every 341 meeting. Reviewing them the night before means you can answer calmly and confidently. You are answering under oath — if you genuinely don't know an answer, say so.
“Did you review your petition before signing it?”
“Is all the information in your petition accurate and complete?”
“Did you list all of your assets?”
“Did you list all of your debts?”
“Have you filed bankruptcy before?”
“Are you expecting any inheritance, insurance proceeds, or lawsuit settlements?”
“Did you transfer any property in the past 2 years?”
“Are you current on any domestic support obligations?”
Never guess. If you are unsure, say “I don't recall” or “I don't know.”
What NOT to Do

After the Meeting
After the meeting, the trustee either closes the case — the most common outcome for no-asset Chapter 7s — or requests additional documents.
